Summary
In today’s meeting, committee discussed the matter sent to committee regarding the motion on removal of Prosecutor General Uz. Hussain Shameem on the matter in accordance with Section 232(b) of the Standing order.
Regarding this issue, before meeting with the Prosecutor General, Thulusdhoo Constituency Member Ibrahim Naseem proposed to have a closed-door meeting for PG to respond to this motion. This proposal was seconded by North Feydhoo Constituency Member Ismail Nizar.
This proposal was passed unanimously with 8 votes.
Second proposal regarding this matter was to have the meeting open to public. This was proposed by Kendhoo Constituency Member Mauroof Zakir and seconded by South Hithadhoo Constituency Member Ibrahim Naazil. This proposal was not passed.
Then, the committee invited the prosecutor general to hear his response to the allegations against him in the motion proposed to the parliament by Hulhudhoo Constituency Member Mohamed Shahid.
After meeting with the PG, Committee decided to make a decision on this motion.
The first proposal was to declare there is no legal basis for the removal of the Prosecutor General from his position. This proposal was proposed by Kendhoo Constituency Member Mauroof Zakir and seconded by South Hithadhoo Constituency Member Ibrahim Nazil. This proposal was not passed.
Second proposal was to remove prosecutor general from his position under the article 228 (a) of the constitution.
This article states;
228. The Prosecutor General shall be removed from office only for the reasons specified in article (a) and in the manner specified in article (b):
Section (a) states “on the ground of misconduct, incapacity or incompetence;”
This was proposed by North Feydhoo Constituency Member Ismail Nizar and seconded by Central Fuvahmulak Constituency Member Ali Fazad. This proposal was passed with the majority of 8 members.
