Summary

Committee met with the Local Government Authority (LGA) regarding the Bill to Ensure Continued Functioning of Decentralized Government 2020. LGA proposed to include in the Bill an Article restricting any transaction of sale or lease of the lands, buildings or any such capital within the jurisdiction of the council by the transitional council. The Committee also discussed the legal opinion of the Attorney General with regard to the Bill. The Attorney General was of the opinion that only a constitutional amendment can extend the term of outgoing local councilors until the delayed local council elections can be held. The Committee also discussed that this is not the time for a constitutional amendment and the purpose of the special Bill is to avoid a constitutional amendment and find an alternative through LGA. Further, by consensus of the committee members present at the meeting, the committee decided to ask for the Counsel General’s opinion and thereafter meet with the sponsor of the Bill.
